Official Rules

  1. Eligibility: The Uncommon Flavors of Europe Deliciously Italian ‘Learn and Earn’ Study Trip to Italy Contest (the “Contest”) is only open to residents of the United States and Canada, with the exception of residents of the Province of Quebec, age 21 and older as of the start date of the Contest. This Contest has two entrant and winner categories: Consumer and Trade Operator. To enter as a Trade Operator, you must meet the criteria set forth immediately above as well as currently be employed as a Cheese Department Team Member, Cheese Manager, Deli Department Team Member, Deli Manager, Demonstrator, Demo Coordinator, Restaurant Chef, Restaurant Manager or Restaurant Wait Staff. This Contest is sponsored by Ponte PR Collaborative, 40 Fourth Street, #270, Petaluma, CA, 94952 (“Sponsor”). Employees, officers, directors, agents, representatives of Sponsor, the legal, promotion and advertising agencies of the Sponsor, and their immediate family members (defined as spouse, mother, father, sisters, brothers, sons, daughters, uncles, aunts, nephews, nieces, grandparents and in-laws, regardless of where they live) and those living in their household (whether or not related), and each person or entity connected with the production or administration of the Contest, and each parent company, affiliate, subsidiary, agent and representative of any aforementioned entity are not eligible. This Contest is subject to all applicable federal, state, and local laws. Void wherever restricted or prohibited by law.
  2. Mandatory Twitter/Facebook/Instagram Disclosure: This Contest is in no way sponsored, endorsed or administered by, or associated with Twitter, Facebook, or Instagram. You are providing your information to Sponsor and not to any of these aforementioned social media platforms. The information you provide will only be used for administering this Contest and for marketing purposes in accordance with Sponsor’s privacy policy, located at http://uncommoneurope.eu/privacy-policy/.
  3. Contest Period: The Contest Period begins on October 28, 2017, at 12:00 AM Pacific Time (“PT”), and ends on May 31, 2019 at 11:59 PM PT PT (the “Contest Period”). ALL ENTRIES MUST BE SUBMITTED DURING THE CONTEST PERIOD. By participating, Contestants agree to be bound by these Official Rules and the decisions of the judges and/or Sponsor, which are binding and final on matters relating to this Contest. All online entries must be received by Friday, May 31, 2019 by 11:59 PM PT.
  4. How to Enter:Online submissions only. There are two categories of entrants and winners, Consumers and Trade Operators. You may choose which category you under which you wish to register, but to register as a Trade Operator, you must meet certain eligibility criteria, which is indicated in the registration form. One registration per natural person, regardless of registration category or method of registration.

Once there, determine whether you’d like to register as a Consumer or a Trade Operator. Then click on the relevant box. You may not register in both categories; only one registration per person regardless of category.

Enter all of the required information on the registration form and create an account. All of your information must be true and accurate. You will be disqualified if any of the registration form information is inaccurate or untrue, including any information related to the Trade Operator information employment.

After creating an account, you can start the Contest.

The Contest has two phases: the video experience and question and answer phase (Phase 1), and the essay question phase (Phase 2). The information you will need will all be under the “My courses” link located at http://uncommoneurope.eu/my-courses/.

You must complete both phases to qualify for the contest. There is no time limit for any portion of either phase other than the Contest Period—keep in mind that all phases must be complete and completed by the close of the Contest Period for your entry to be valid.

 

Phase 1 instructions: Once you have completed your registration form and created your account, you will find the videos that you must watch here http://uncommoneurope.eu/my-courses/. The number of videos you must watch will depend on whether you have entered as a Consumer or a Trade Operator. In order to complete Phase 1, you must watch each video (4 for Consumers and 5 for Trade Operators) and answer the questions asked after each one.

 

Phase 2 instructions: Once you have completed Phase 1, you will be asked to write an essay describing your dream educational trip to Italy. Your essay must be 500 words or less and must include information you learned from the videos and the quizzes from Phase 1. Your essay must be your own, creative, original work. You will find instructions on how to enter your essay in your account page.

 

One submission per natural person regardless of entry category. To be clear, you may not enter in both registration categories. Attempting to complete a phase more than once will not earn any additional points or entries. Entries from the same person using multiple or different email addresses will not be accepted. Anyone who registers in both categories will have all entries disqualified.

 

Submissions must be received no later than May 31, 2019 at 11:59 PM PT according to Sponsor’s internal server time. No other methods of entry will be accepted. All submissions received by the end of the Contest Period that are complete, meet the Submission Guidelines in Sponsor’s sole discretion, and are otherwise qualified will be eligible to win within their submission category (“Qualified Submissions”). Sponsor reserves the right to disqualify any Contestant it finds to be tampering with the entry process or the operation of the Contest or violating these Official Rules. Sponsor is not responsible for incomplete, late, lost, delayed, damaged, misdirected, incomplete, void, corrupted, garbled, illegible, or unintelligible Submissions and those Submissions are void and will not be accepted; nor is Sponsor responsible for any problems, bugs, or malfunctions Contestants may encounter when seeking to enter their Submissions. Proof of submitting any Submission is not considered proof of delivery to or receipt of such Submission.

 

Odds of Winning:  The odds of winning a prize depend upon the number of eligible entries received in each entry category.

 

  1. Submission Guidelines and Permissions:

Your Submission in all phases of the Contest should be creative and original. All answers and essays must be provided and created by the person who submits the entry. You must be the original author of everything in your essay. Do not plagiarize, copy, or steal any written material from anyone else or from the internet.

 

By entering, you warrant that your essay does not infringe any third party’s rights. If, in the sole discretion of Sponsor, your Submission constitutes copyright infringement, the Submission will be disqualified. Contestant agrees to indemnify Sponsor against any and all claims of infringement from any third party for any use by Sponsor of the essay in any marketing or promotion of this or any other Contest.

 

Respect: Any Submission that is considered by Sponsor in its sole discretion to be offensive, obscene, libelous, inapposite to the reputation of Sponsor or any of Sponsor’s partners or affiliates, or to portray Sponsor in a negative light, or otherwise objectionable or inappropriate, or which otherwise does not comply with these Official Rules will be disqualified.

 

Permission: Entering a Submission constitutes Contestant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such Submission in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology, now known or later developed, including for promotional or marketing purposes.  Contestant also waives all moral rights to the Submission. Contestants will not be paid for their Submissions or for granting Sponsor any of these rights.

 

  1. Judging: Judging will be completed in two rounds, one per phase. Only Qualified Submissions shall be judged.

Phase 1 judging criteria: You are awarded points based on the number of correct answers you provide in the quizzes. Only submissions that receive a score of 80% correct or higher will move on to the second round of judging.

Phase 2 judging criteria: The Phase 2 essay is judged according to the following criteria:

 

  • Creativity (35 points)
  • Prominence of Themes From the Videos Within the Essay (35 points)
  • Originality (30 points)

 

The point totals from each phase are added together to arrive at Total Points for each Qualified Submission. In the event of a tie, double value will be given to the Prominence criteria.

 

  1. Prizes: Four (4) Trade Operator winners residing in the USA, one (1) Trade Operator winner residing in Canada and two (2) Consumer winners residing in the USA or Canada will each receive: one coach class round-trip airfare ticket to Rome, Italy or another airport of Sponsor’s choice departing from a major international airport closest to your home; a baggage allowance of up to one bag if a charge is assessed by the relevant airlines; a 3 night stay at a 3-star or better hotel in Asiago Italy; one way coach class airfare ticket from Venice, Italy to Olbia Italy; a 2 night stay at a 3-star or better hotel in Olbia Italy; all ground transfers; tours of the production and production areas of Asiago PDO cheese, Speck Alto Adige PGI cured ham, and Pecorino Romano PDO cheese.All winners will travel together for the trip which is scheduled with an approximate departure of Wednesday, September 25, 2019 and a return of Tuesday, October 1, 2019. Booking dates for airline tickets are subject to availability and may be changed at the discretion of the Sponsor. The specifics of the prize shall be solely determined by the Sponsor. The prize is nontransferable. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of the prize or transfer/assignment of the prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission to Sponsor to use winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law.Approximate Retail Value (“ARV”) of each trip is $4,260 USD. Total ARV: $21,250 USD.

 

All winners must have all necessary identification to claim the prize and to travel. Choice of airline(s) and hotel(s) shall be at the discretion of Sponsor. Prize may be awarded in the form of coupon(s), voucher(s) and/or gift card(s). Actual value of travel prizes may vary based on point of departure and airfare fluctuations. Once airline tickets and hotel reservations have been issued, they shall not be changed, re-sold, endorsed, exchanged, transferred, or in any other manner modified by Selected Contestant. All seven (7) winners will travel as a group at a time identified by the Sponsor. Travel arrangements are subject to availability and to the terms and conditions of the airline and hotel. Selected Contestant is solely responsible for any other unspecified expenses related to the travel prize, including without limitation: meals, ground transportation, gratuities, incidental hotel expenses, upgrades, and any and all federal, state, and local taxes on prize, including special airport taxes and fees. Sponsor will make all necessary reservations including, but not limited to, lodging and dining reservations as needed. Selected Contestant is not entitled to any surplus between actual retail value of prize and stated ARV and any difference between stated ARV and actual value of the prize will not be awarded. No substitution, transfer, or cash redemption of prize, or cash for any portion of prize not used, provided however that Sponsor reserves the right to substitute a prize with another prize of equal or greater value should the advertised prize become unavailable for any reason. Any and all activities related to the prize, without limitation, are at the winner’s own risk and subject to whatever restrictions are imposed by the entities that govern activities. The winner must participate in all parts of the trip. If the winner does not want to participate in any portion of the trip, the entire trip is forfeited.

 

  1. Winner selection and notification: The five (5) Qualified Submissions in the Trade Operator category and the two (2) Qualified Submissions in the Consumer category with the highest total points shall be deemed Potential Winners. Once the points are tallied and the highest point achievers are identified, Potential Winners will be notified by either phone or email using the email address provided in the registration form at the sole discretion of Sponsor or Sponsor’s representative on or about July 1, 2019. Potential Winners will be required to respond (as directed) to a phone and/or e-mail notification within 5 days of attempted notification. The failure to respond timely to the notification may result in forfeiture of the prize; and, in such case, Sponsor may choose the next highest scoring Qualified Submission from among the remaining Qualified Submissions. Potential Winners will be required to sign and return a Declaration of Eligibility and Liability/Publicity Release (“Declaration”) and any other documents Sponsor or Sponsor’s representative may require within 48 hours of receipt of the Declaration. Failure to timely return a signed Declaration or other required documents or the return of any prize notification as undeliverable will result in Prize forfeiture. Federal, provincial and state income taxes may apply and are the sole responsibility of Potential Winners; Potential Winners may be issued an IRS Form 1099 for the ARV of any awarded prize. All expenses not specifically stated as being included are excluded, and are the responsibility of the Potential Winners.

 

Sponsor shall have no liability for a Potential Winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for Potential Winner’s provision of incorrect or otherwise non-functioning contact information. The receipt by Potential Winner of a prize is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER OR POTENTIAL WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER OR POTENTIAL WINNER’S DISQUALIFICATION AND ALL PRIVILEGES AS WINNER OR POTENTIAL WINNER WILL BE IMMEDIATELY TERMINATED.

 

  1. Conditions: Contest is subject to these Official Rules. By participating, Contestants agree: (i) to be bound by these complete Official Rules and the decisions of Sponsor which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Contest or these Official Rules, except where prohibited by law. By accepting a prize, Winner agrees to release Sponsor, including its parent, subsidiary, and affiliated entities together with the respective directors, employees, officers, licensees, licensors, and agents, and respective advertising and promotion entities and any person or entity associated with the production, judging, or administration of the Contest (collectively, the “Releasees”) from any and all liability, loss, or damage arising from or in connection with awarding, receipt, and/or use or misuse of prize or participation in any prize-related activities. Releasees shall not be liable for: (i) telephone system, telephone or computer hardware, software, or other technical or computer malfunctions, lost connections, disconnections, delays, or transmission errors; (ii) data corruption, theft, destruction, or unauthorized access to or alteration of entry or other materials; (iii) any injuries, losses, or damages of any kind, including death caused by the prize or resulting from acceptance, possession, or use of a prize, or from participation in the Contest; or (iv) any printing, typographical, administrative, or technological errors in any materials associated with the Contest. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest.  Sponsor reserves the right to cancel or suspend the Contest, in its sole discretion, should it receive fewer than 20 entries, or receive no entries that have a judged score above 60 points, or due to circumstances beyond its control, including natural disasters.  Submissions will not be returned and may be destroyed.

 

Sponsor reserves the right, in its sole discretion, to cancel, modify, or suspend the Contest should a virus, bug, computer problem, unauthorized intervention, or other causes beyond Sponsor’s control, corrupt the administration, security, or proper play of the Contest.  Sponsor may prohibit a Contestant from participating in the Contest or winning prize if, in its sole discretion, it determines such Contest is attempting to undermine the legitimate operation of the Contest in any way by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten, or harass any other players or Sponsor representatives. Use of automated entry devices or programs is prohibited. Any attempts to access the site, enter the Contest, or increase votes or views via a bot script, device, or brute-force attack will result in disqualification, including that IP address becoming ineligible for the entire Contest. Caution: any attempt to deliberately damage or undermine the legitimate operation of the Contest may be in violation of criminal and civil laws and will result in disqualification from participation in the Contest.  Should such an attempt be made, Sponsor reserves the right to seek remedies and damages (including attorney fees) to the fullest extent of the law, including criminal prosecution.

 

  1. Limitation of Liability: By entering you agree to release and hold harmless Ponte PR Collaborative and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error which may occur in the administration of the Contest or the processing of entries.

 

  1. Publicity: Sponsor reserves the right to use the name, likeness, and/or hometown name of any Contestant for publicity purposes prior to, during, or after the Contest end date, in any media, and to use throughout the world, in perpetuity, without any compensation or prior review unless specifically prohibited by law. By participating, Contestants agree that Sponsor, its agents and representatives, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors are not responsible or liable for, and shall be released and held harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with or resulting from participation in the Contest, or acceptance of the prize, including without limitation, claims based on publicity rights, defamation, or invasion of privacy. Should any Potential Winner be unwilling or otherwise unable to provide permissions and/or releases, or otherwise cannot accept or receive the prize for any reason, the Potential Winner with the next highest score will be chosen from the remaining Qualified Submissions until one who is able to meet all requirements can be selected.

 

  1. Waiver of Jury Trial and Choice of Law. Except as prohibited by applicable law and as a condition of participating in this Contest, each Contestant hereby irrevocably and perpetually waives any right s/he may have to a trial by jury in respect of any litigation directly or indirectly arising out of, under, or in connection with this Contest, any document or agreement entered into in connection herewith, any prize available in connection herewith, and any of the transactions contemplated hereby or thereby. The internal laws of the State of California will govern disputes regarding these Official Rules and/or this Contest. All cases and claims pertaining to this Contest must be brought in a court of competent jurisdiction in the City of San Francisco. As a condition of participating in this Contest, Contestant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will Contestant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Drawing), and participant further waives all rights to have damages multiplied or increased.
